These Terms And Conditions (“Terms”) are applicable to any order by a visitor (“Customer”) of this e-commerce website. Placing an order on this website includes acceptance of the Terms. Any conditions brought forward by the Customer are void unless written agreement by Godfrieds
All prices are in EURO, inclusive VAT. the prices are delivery costs included, keeping in mind that we only deliver in the Benelux countries.The prices we calculate can be variable depending on measurements of the customer(MTM Made to measure) or the sizes of the ordered style (STD standard sized clothing),because of this you will see in our catalog advised prices , as soon as the measurements (MTM) or sizes (STD) are entered the system will recalculate the prices when entering the shopping cart and will be visualized to the customer.For MTM or made to measure garments the recalculated price is displayed in the cart. If any other costs (delivery, reservation, administrative) apply, they will be mentioned separately.The quoted price is valid for the articles selected and as such mentioned. Any pictures of products are merely of decorative nature and may include elements not quoted in the price.
3: Our offer
We ‘ve taken great care in creating this e-commerce webshop. However, we might have made mistakes in being complete or up-to-date. Such honest mistakes cannot be held against Godfrieds and Godfrieds can in no way be held responsible for any errors in print.If you have any question about sizes, colors, availability, terms of delivery or any other, please contact us. Our offer can be changed at all times by Godfrieds. Godfrieds cannot be held responsible for any unavailability of a product and Godfrieds can withdraw at any time the availability of products.
4: Buying Online
The customer a style of his choice, after selecting the customer has the choice of different variations for this style for example :
these variations depend on the style and can influence the price, aside from these variations the customer has to enter also measurements specific for the chosen style, they appear automatically on the screen after adding to the cart and can only be consulted IN the cart.
for MTM (made to measure) garments these measurements are measurements related to the wearer (body), measurements related to the style and oversize measurements related to the style (to define the fitting) for example :
- 110 circumference of belt
- 120 side length
- 1000 oversize Belt
for STD (standard sized) garments these measurements are measurements related to the style for example :
for these STD garments, a measurement chart can be consulted for each style (FAQ), in which all the detailed measurements are consultable. If the customer wants to continue he can add the selection to the cart. After adding to the cart , the system will calculate and show the new price.This cart can be consulted and changed (adding or deleting articles). If the customer wants to proceed and buy the selected product he can continue to the checkout, however from now on we need the customer to log in to our system as an authenticated user otherwise the "checkout button" will not appear. In the Checkout the customer will have to enter the data for shipment, address ...
For both versions STD as MTM, we use a tolerance of 3% on all dimensions and check these dimensions before departure of our goods, however, by the fact that we work with 100% natural raw materials and we don't know the washing conditions and wearing conditions and humidity conditions at the customer, we will not accept any complaint about dimensions.
All the measurements data is kept and can be used again in case of later purchases without having to enter them again.
After this, in the control window all the data of the order is visualized again and the customer can continue with the payment or not, this can be done according to the payment methods we have mentioned at the bottom of all web pages, please note these methods can vary country by country.

Godfrieds is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.
5: Processing Orders and Delivery
After payment, the system generates an order number and a confirmation email is sent to the customer.
After this payment, we start the production of the clothing that we normally send to the customer within 7 working days. If due to lack of raw materials, or other factors that may affect our delivery period, the delivery period will not be met, we will inform the customer of this, under no circumstances will the customer be able to demand compensation for this, if Godfrieds so wishes he can cancel the purchase and refund the already paid price.
For all our shipments we use the services of Bpost where the customer has a choice from their (Bpost) package of delivery options, the follow-up of the shipment can also be followed on the Bpost website. As mentioned before, the shipping costs are included in the price and are only delivered within the Benelux. The delivery times are therefore according to these as handled by Bpost.
Any visible damage and/or qualitative deficiency of an article or other defects in the delivery must be reported to Godfrieds immediately by the Customer.
Because we work with Raw unwashed denim, it is possible that these garments will bleed off color (crocking), especially on light colored surfaces. Godfrieds can under no circumstances be held responsible for any damage caused by this.
The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, which is not the carrier) has received the goods physically. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier of the Customer has been instructed to transport the goods and this choice was not offered by Godfrieds.
Any delivered goods remain property of Godfrieds until full payment by the Customer. If need be, the Customer shall mention the ownership of any such goods to any third party claiming aforementioned goods.
7: Right of withdrawal
These terms only apply for a Customer who buys online from this e-commerce website as a consumer. Companies cannot execute a right of withdrawal.
1 for goods type STD (standard)
The Customer has the right to revoke the agreement for garments of type STD (standard) within a period of 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, is physically in possession of the good.
In order to exercise the right of withdrawal, the Customer must inform Godfried Vanden Daele Molenstraat 30 8720 Wakken in Belgium or by telephone +32 496 362 906 or by mail email@example.com through an unambiguous statement of his decision to withdraw from the contract. The Customer can use the attached model withdrawal form for this purpose but is not obliged to do so.
2 for goods of the type MTM , made to measure or CSTD and CMTM, customized, are made according to the sizes and/or wishes of the customer, the normal right of withdrawal does not apply.However, if the customer is not satisfied with the result, the article of clothing can be sent in writing to Godfried Vanden Daele Molenstraat 30 8720 Wakken Belgium or by phone +32 496 362 906 or by mail firstname.lastname@example.org via an unequivocal statement of his griefs.Godfried's will accept the return of the garment 1 time, shipment at the expense of the customer, and Godfrieds will attempt to make the garment according to the wishes of the customer,if there is after this attempt still no satisfaction with the customer then the money is refunded after the return of the garment back at the expense of the customer. However, it is so that only customized problems and personalization problems are eligible, general aspects such as look, aspect and feel of the garment or fabric or used materials or finishes are not eligible and therefore no right of withdrawal applies.
Godfrieds will not accept returns of garments washed by the customer, only garments that are still in the state as they have been delivered by Godfrieds will be accepted to return.In order to comply with the withdrawal period (point 1 STD) or the return of (item 2 MTM CSTD CMTM), the Customer must send his notice concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return the goods without delay, but in any case no later than 14 calendar days after the day on which he has notified his decision to cancel the agreement to Godfrieds, or hand it over to Godfried Vanden Daele Molenstraat 30 8720 Wakken Belgium. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.The direct costs of returning the goods are at the expense of the Customer.If the returned product is reduced in value in any way, Godfrieds reserves the right to hold the Customer liable and demand compensation for any value reduction of the goods resulting from the Customer's use of the goods. Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.If the Customer cancels the agreement, Godfrieds will refund all payments received by the Customer, including standard delivery costs, to the Customer up to that time within a maximum of 14 calendar days after Godfrieds has been informed of the Customer's decision to use the right of withdrawal. Godfrieds can wait for the refund until he has received all goods back, or until the Customer has shown that he has returned the goods, whichever comes first.Any additional costs resulting from the Customer's choice for a different delivery method than the cheapest standard delivery offered by Godfrieds will not be refunded.Godfrieds will refund the Customer with the same payment method with which the Customer has performed the original transaction unless the Customer has explicitly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.
8: Warranty and repairs
Pursuant to the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the customer has statutory rights. This legal guarantee applies from the date of delivery to the first owner. Every commercial guarantee leaves these rights unabated.
In order to make use of the guarantee, the Customer must be able to present a proof of purchase. Customers are advised to keep the original packaging of the goods.
For articles that were purchased online and delivered to the Customer's home, the Customer must contact the Godfried customer service and return the item to Godfrieds at his expense.
Upon detection of a defect, the Customer must inform Godfrieds as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been determined. Afterwards, no right to repair or replacement lapses.
The warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article in violation of the purpose for which it was designed, non-observance of the instructions for use or manual, modifications or changes to the article, crackdown , poor maintenance, or any other abnormal or incorrect use.
Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, shall be deemed to be no hidden defects unless the Customer proves otherwise.
We offer the possibility to our clients to send back garments, that have been produced and sold by Godfrieds, to repair.
To do so send us an email (contact@Godfrieds) to inform us about the damage to repair, so we can confirm how we'll proceed,it is possible that we decide not to repair when the damage is to bad.After we agree, the client can ship the damaged goods.The shipping to us will be paid by the client and in no way Godfrieds will be responsible for problems during this transport such as damage, losses or other issues.
After inspection of the goods to repair and before repair we'll send a proposal and price indication for the repair, it is up to the client to decide whether or not he’ll accept this.
After payment the goods will be repaired an sended back to the client, shipment paid by Godfrieds.

10: Sanctions for non-payment
On top of Godfrieds other rights, the Customer will be liable to pay 10% interest per year for any non-payment and this without notice, heightened with 10% of the unpaid goods as damages, with a 25 euro per invoice minimum.Notwithstanding the foregoing, Godfrieds reserves the right to take back the non (fully) paid items.
Godfrieds respects the Belgian law of December 8, 1992 concerning the protection of privacy. Your personal data ,knowing invoice data, shipment data , body measurements and payment data ,shall only be used to construct the patterns of the garments ,to execute the Customer’s order,ship the order and keeping an order history , newsletters and publicity and/or marketing. The Customer has a right to see and correct his personal data. A copy of passport or identity with a written, dated and signed request to Godfrieds shall result in a free written form of your personal data. If need be, the Customer can ask to correct any data proving incorrect. The Customer can ask to be excluded from direct marketing.Any info about the Customer is considered Personal And Confidential and will not be sold, rented of given to any third parties thas don’t work with us.The data will be stored in our systems for 50 months .
Part of the data will be shared to our shipment partner who will only receive the data needed to ship the orders.
Part of the data will be shared to our acquirer who will receive only the data needed execute the payment , the data the client shares to the acquirer is not stored on our system.

14: Changing the Terms And Conditions
These Terms And Conditions may be joined by other Terms And Conditions if so mentioned. If any contradictory arises, these Terms And Conditions will come first. Godfrieds can alter these Terms And Conditions at any time without notice. Any purchase after a change in the Terms And Conditions show acceptance of the new Terms And Conditions by the Customer.
The Customer accepts that any electronic communication and back-ups can be used in evidence.
16: Which Law, which Judge
The Belgian Law applies, exception made for the international private laws and the Rome-I law about international buy-agreements for goods. The Gent Court in Belgium is the only qualified Court to judge any disagreements. the customer can also use the ODR-platform (http://ec.europa.eu/consumers/odr/).
